THE SUBMISSION OF SIGNIFICANT ADDITIONAL DATA IN RELATION TO CASE REFERENCE NUMBER ABP-306146-19

In accordance with Section 51 (2) of the Roads Act 1993, as amended, Limerick City and County Council made an application for permission to An Bord Pleanála on the 11th December, 2019 in relation to the proposed Foynes to Limerick Road (including Adare Bypass) including all ancillary and consequential works.

An Environmental Impact Assessment Report (EIAR) and a Natura Impact Statement (NIS) were submitted as part of this planning application.

On 30th September, 2020, Limerick City and County Council submitted to An Bord Pleanála a response to a further information request.  An Bord Pleanála has determined that the further information contains significant additional data in relation to the likely effects on the environment of the proposed road development.

The further information response, together with the original planning application documentation, EIAR and NIS, may be inspected free of charge at the following locations from Thursday 22nd October 2020 to Wednesday 2nd December 2020 (with the exception of public holidays):

Submissions or observations in relation to the further information response may be made in writing to An Bord Pleanála (The Board), Strategic Infrastructure Development Section, 64 Marlborough Street, Dublin 1 D01 V902 relating to:

(i)   The implications of the proposed road development for proper planning and sustainable development.

(ii)    The likely effects on the environment of the proposed road development.

(iii)   The likely significant effects of the proposed road development on a European site, if carried out.

Any submissions/observations, except those by certain prescribed bodies or persons who have already made a valid written submission to the Board regarding the application must be accompanied by a fee of €50. Submissions or observations must be received by the Board no later than 5.30 p.m. on Wednesday 2nd December 2020.  Such submissions/observations must also include the following information:

(i)   The name of the person making the submission or observation, the name of the person acting on his or her behalf, if any, and the address to which  any correspondence  relating to the application should be sent;

(ii)    The subject matter of the submission or observation; and

(iii)  The reasons, considerations and arguments on which the submission or observation is based in full.

Any submissions or observations which do not comply with the above requirements cannot be considered by the Board.

A person may question the validity of any decision by the Board on a proposed road development by way of an application for judicial review, under Order 84 of the Rules of the Superior Courts (S.I. No. 15 of 1986, as amended by S.I. No. 691 of 2011) in accordance with section 50 of the Planning and Development Acts 2000-2020 (as amended).
