King’s Island Flood Relief Scheme

Submission of further information containing significant additional data to An Bord Pleanála

Case Number: ABP-306270-19


Limerick City and County Council made an application to An Bord Pleanála on 20th December 2019 in relation to the proposed King’s Island Flood Relief Scheme. An Environmental Impact Assessment Report (EIAR) and Natura Impact Statement (NIS) were submitted as part of this planning application. On 29th October 2020, Limerick City and County Council submitted to An Bord Pleanála a response to a further information request. An Bord Pleanála has determined that the further information contains significant additional data in relation to the likely effects on the environment of the proposed development and the likely consequences for the proper planning and sustainable development in the area in which it is proposed to situate the said development.


The further information response, together with the original planning application documentation, EIAR and NIS will be available for inspection free of charge, or may be purchased on payment of a specified fee (which shall not exceed the reasonable cost of making such a copy) during public opening hours excluding Public Holidays from Thursday 19th November 2020 to Thursday 07th January 2021 (inclusive of both dates) at the following locations:

  • The Offices of An Bord Pleanála, 64 Marlborough Street, Dublin 1, D01 V902
  • Limerick City and County Council, Corporate Headquarters, Merchant’s Quay, Limerick, V94 EH90


For the purpose of facilitating continued public participation in the planning process due to restrictions of movement due to Covid-19, Regulation 5(2) of the Health Act 1947 (Section 31A – Temporary Restrictions) (Covid-19) (No. 8) Regulations 2020 (S.I. No. 448 of 2020) further explicitly provides that a reasonable excuse for travelling or moving includes travelling or moving in order to - “(y) attend the offices of a planning authority or An Bord Pleanála to engage in a statutory planning process (including making or inspecting a planning application or appeal, making an observation or submission or participating in a Development Plan process) or inspect a site notice (within the meaning of the Planning and Development Act 2000 (No. 30 of 2000)).” During Level 5 restrictions the offices of An Bord Pleanála remain open to the public while the offices of Limerick City and County Council are closed to the public. However, inspection of the documentation at the offices of Limerick City and County Council may be arranged by appointment, Monday to Friday: 9am to 5pm by phoning 061 557180.

Submissions or observations in relation to the further information response may be made in writing only to An Bord Pleanála (‘the Board’) 64 Marlborough Street, Dublin 1, D01 V902 in respect of:

  1. The implications of the proposed development for proper planning and sustainable development in the area concerned, and
  2. The likely effects on the environment of the proposed development, if carried out, and
  3. The likely significant effects of the proposed development on a European site, if carried out.


Any submissions/observations must be accompanied by a fee of €50 (except for existing observers to the case before the Board and certain prescribed bodies who are not required to pay a fee) and must be received by the Board not later than 5.30 p.m. on Thursday 07th January 2021. Such submissions or observations must include the following information:

  1. The name of the person, authority or body making the submission or observation, the name of the person, if any, acting on behalf of that person, authority or body, and the address to which any correspondence relating to the application should be sent,
  2. The subject matter of the submission or observation, and
  3. The reasons, considerations and arguments on which the submission or observation is based in full.


Any submissions or observations which do not comply with the above requirements cannot be considered by the Board.

An Bord Pleanála may give approval to the application for development with or without conditions or may refuse the application for development.


Any person may question the validity of any such decision of the Board made in respect of the application for permission by way of an application for judicial review, under Order 84 of the Rule of the Superior Courts (S.I. No. 15 of 1986, as amended by S.I. No. 691 of 2011), in accordance with Section 50 of the Planning and Development Act, 2000 as amended.
