NOTICE OF THE MAKING OF A COMPULSORY PURCHASE ORDER UNDER SECTION 76 OF AND THE THIRD SCHEDULE TO THE HOUSING ACT 1966, AS EXTENDED BY SECTION 10 OF THE LOCAL GOVERNMENT (NO. 2) ACT 1960 (AS SUBSTITUTED BY SECTION 86 OF THE HOUSING ACT, 1966) AND AMENDED AND EXTENDED BY THE PLANNING AND DEVELOPMENT ACTS 2000 - 2022 (AS AMENDED) INCLUDING SECTION 213 OF THE PLANNING AND DEVELOPMENT ACT 2000 (AS AMENDED), SECTION 10 OF THE LOCAL GOVERNMENT (IRELAND) ACT 1898, AS AMENDED BY SECTION 11 OF THE LOCAL GOVERNMENT (NO.2) ACTS 1960, THE LOCAL GOVERNMENT ACTS 1925 – 2024 INCLUDING SECTION 11 AND 184 OF THE LOCAL GOVERNMENT ACT, 2001, THE LOCAL GOVERNMENT (NO. 2) ACT 1960 (AS AMENDED), ROADS ACTS 1993 - 2015 AND ALL OTHER ACTS THEREBY ENABLING TO BE PUBLISHED IN ACCORDANCE WITH ARTICLE 4(A) OF THE THIRD SCHEDULE TO THE HOUSING ACT 1966 (AS AMENDED)
Limerick City and County Council (hereinafter referred to as “the local authority”) in exercise of the powers conferred upon them by section 76 of the Housing Act, 1966, and the Third Schedule thereto, as extended by section 10 of the Local Government (No. 2) Act, 1960 as substituted by Section 86 of the Housing Act, 1966, as amended by Section 6 and the Second Schedule to the Roads Act, 1993 and as amended by the Planning and Development Acts, 2000 to 2022, has made an order entitled as above which is about to be submitted to An Bord Pleanála (hereafter “The Board”) for confirmation.
If confirmed, the order will authorise the local authority to acquire compulsorily the land, rights of way, easements and other rights described in the Schedule hereto for the purposes of giving effect to the objectives contained in the Limerick Development Plan 2022-2028.
Limerick City and County Council are seeking to acquire compulsorily the lands described in the Schedule hereto for the purpose of upgrading the Cappamore Junction, Garraunykee & Woodstown, Limerick in accordance with the approval granted under Section 179 3(a) of the Planning and Development Act 2000 (as amended) and Part 8 of the Planning and Development Regulations 2001 (as amended) on 20th September, 2021.
Owners, lessees and occupiers of the land described in the Schedule will receive individual written notices.
The Board may, at its discretion, decide not to confirm:-
- a compulsory purchase order in respect of the land if an objection is made in respect of the acquisition by an owner, lessee or occupier of the land, and not withdrawn,
- Until it has caused to be held, an oral hearing into the matter and until it has considered the objection(s) and the report of the person who held the oral hearing.
- The Board may, at its absolute discretion, decide to hold an oral hearing into the matter.
Any objection to the order must state in writing the grounds of the objection and be sent addressed to An Bord Pleanála, 64 Marlborough Street, Dublin 1, D01V902 so as to reach the said Board no later than 5.30pm on Wednesday 6th November, 2024.
A copy of the order and map will be available for inspection and/or purchase at a fee not exceeding the reasonable cost of making a copy, from Monday 23rd September, 2024 up to and including Wednesday 6th November, 2024 during public opening hours (excluding bank holidays) at the

- The order and map will also be available for inspection online during the above timeframes at https://mypoint.limerick.ie.
