ATHEA FLOOD RELIEF SCHEME

Further Information Planning and Development Act 2000 (as amended)

Planning and Development Regulations 2001 (as amended)

In accordance with Section 177AE of the Planning and Development Act 2000 (as amended) and the Planning and Development Regulations 2001 (as amended), Limerick City & County Council has sought the approval of An Bord Pleanála to carry out the following works located in the townlands of Templeathea West and Gortnagross: 

  • Removal of excess gravel build up in the River Galey in the vicinity of Athea Bridge

Notice is hereby given that significant further information in relation to the proposed development has since been furnished by Limerick City & County Council to An Bord Pleanála.

A Natura Impact Statement (NIS) has been prepared as part of the application for approval in respect of the proposed development.  The further information furnished by Limerick City & County Council to An Bord Pleanála includes a revised NIS.

 Submissions and observations in respect of the proposed development relating to:

  • the implications of the proposed development for proper planning and sustainable  development in the area concerned,
  • the likely effects on the environment of the proposed development, and 
  • the likely significant effects of the proposed development on a European site.

 may be made to An Bord Pleanála, 64 Marlborough Street, Dublin 1 and must be received no later than 5.30 pm on 11 March 2022.

A copy of the additional information received by An Bord Pleanála and the original documents submitted with the application, which include the NIS, and the documents, particulars plans, and other information relating to the application, may be inspected at the following locations (by prior appointment only):

  • Limerick City and County Council, Merchants Quay, Limerick, V94 EH90, between the hours of 9.00 am and 5:00 p.m on working days from 17 February 2022 to 11 March 2022 (inclusive of both dates).  

  • Limerick City and County Council, Newcastle West Area Office, Áras William Smith O’Brien, Sheehan’s Road, Newcastle West, V42 EH73, between the hours of 9.00 am and 5:00 p.m on working days from 17 February 2022 to 11 March 2022 (inclusive of both dates).  

  • the offices of An Bord Pleanála, 64 Marlborough Street, Dublin 1 between the hours of 17 February 2022 to 11 March 2022 (inclusive of both dates).

The revised Natura Impact Statement (full text) may be purchased on payment of a fee of €25. Copies are also available on USB for purchase on payment of a fee €10.

In relation to the proposed development, An Bord Pleanála may:  

  • Approve the proposed development
  • Approve the proposed development with modifications 
  • Refuse to approve the proposed development 

A person may question the validity of a decision of the Bord by way of an application for judicial review, under Order 84 of the rules of the Superior Courts (S.I. No.15 of 1986) in accordance with section 50 of the Planning and Development Act 2000, as amended.
